The U.S. District Court for the Western District of New York has dismissed, without prejudice, the federal government’s lawsuit challenging the city of Rochester’s sanctuary city policy.
“We are pleased with the dismissal of the current lawsuit,” says Mayor Malik Evans. “The City of Rochester became a Sanctuary City in 1986, and remains committed to this resolution. The City intends to continue to fully comply with federal and state laws while vigorously preserving our local autonomy and rights under the Tenth Amendment to the U.S. Constitution.”
The U.S. Department of Justice filed a lawsuit against the city of Rochester in April, alleging that the city’s sanctuary city policies, which were reaffirmed in 2017, unlawfully hinder federal immigration enforcement efforts. The complaint sought to invalidate Rochester’s sanctuary policies and require the city to cooperate with federal immigration authorities. Since then, and while the case was underway, the city codified and amended its sanctuary city policy.
In his decision, Judge Frank Geraci Jr. noted the lawsuit had become moot because the court could no longer provide any effectual relief after Rochester enacted its new amendments in August.
The Department of Justice has until Dec. 19 to file an amended complaint.

While morally and ethically correct, Sanctuary Cities in fact do far more harm than good. Paining targets on the backs of aliens (illegal or legal) and on the backs of the cities only serves to give Trump and his ICE stormtroopers an excuse for their thuggery.
I agree, we need to just do exactly what Trump wants and sort of (oh what’s the word? oh right!) appease his ego! That approach has never gone wrong from any historical examples I can think of! Then he’ll definitely for sure leave us alone and not find another justification to go after his perceived enemies!
